Terms and Conditions
These terms and conditions ("Terms") apply when you request a quote or book an Energy Performance Certificate ("EPC") assessment through simple-epc.uk (the "Website"). By booking, you enter a contract with us on these Terms. Please read them before you book.
1. Who we are
The Website is operated by Garden One Ltd ("we", "us", "our"). Garden One Ltd is registered in England and Wales, company number 10975247, registered office Apollo House, Hallam Way, Whitehills Business Park, Blackpool, United Kingdom, FY4 5FS. Contact: contact@garden-one.co.uk.
2. Our service
2.1 We provide EPC assessment services for domestic properties in England and Wales. Your contract is with us.
2.2 Assessments are carried out on our behalf by accredited domestic energy assessors we appoint for your booking. Depending on the job, we may instruct an assessment company (such as Easy EPC) or an accredited assessor selected from the national register directly ("our Assessor"). In every case, we remain responsible to you for the service under these Terms.
2.3 The EPC is produced by the accredited assessor and lodged on the national EPC register, as required by law.
3. Quotes
3.1 When you submit your details through the Website, we will send a quote to the email address you provide. A quote is an invitation to book, not a contract.
3.2 Quotes are based on the information you give us. If the property differs materially from that information (for example, a different property type or size), we may revise the price before or at the point of the assessment. If a revised price is not agreed, either of us may cancel and we will refund any payment for work not carried out.
3.3 Quotes are valid for 14 days unless we say otherwise.
4. Price and payment
4.1 A booking is made when you accept a quote and we confirm your appointment to you by email. The contract between us is formed when we send that confirmation.
4.2 The price for your assessment is the price set out in your quote. All prices are in pounds sterling (GBP) and are the total amount payable by you, inclusive of VAT where applicable. There are no hidden charges: the price we quote is the price you pay, unless clause 4.4 applies.
4.3 We take payment after the assessment has been carried out and before your EPC is lodged on the national register, by bank transfer. Your EPC will be lodged once payment has been received.
4.4 The price is based on the information you give us. If the property differs materially from that information (for example, it is larger or a different property type), we may need to revise the price. We will tell you before the assessment is carried out, and you may either accept the revised price or cancel and receive a full refund of anything you have paid for work not yet done.
5. Your responsibilities
You agree to:
- provide accurate and complete information about the property;
- confirm you own the property or are authorised to arrange an assessment;
- provide safe access to the property, including all rooms, the loft hatch where present, and the boiler/heating system, at the agreed time; and
- ensure an adult (18+) is present or has authorised access.
If the Assessor cannot gain access at the agreed appointment, an abortive visit fee of 50% of the quoted price applies, and re-booking may be required.
6. Cancellation and your statutory rights
6.1 Your 14-day right to cancel. As a consumer buying a service at a distance, you may cancel the contract within 14 days of our booking confirmation without giving a reason (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013).
6.2 Assessments within the 14-day period. If you ask us to carry out the assessment before the 14-day period ends, you expressly request early performance and acknowledge that:
- if the assessment has been carried out within the period, you lose the right to cancel, whether or not the EPC has yet been lodged; and
- if you cancel after performance has begun but before completion, you must pay a proportionate amount for what has been done.
6.3 How to cancel. Email contact@simple-epc.uk with your name, property address and booking reference. You may use the model cancellation form in the Schedule but do not have to. Refunds due are made within 14 days using your original payment method.
6.4 Rescheduling and our cancellations. You may reschedule free of charge with at least 48 hours' notice. We may cancel where the property is materially different from that described, where access is unsafe, or for events outside our reasonable control; we will refund any sums for work not carried out.
7. Performing the service
7.1 We will provide the service with reasonable care and skill, as required by the Consumer Rights Act 2015.
7.2 Appointment times are agreed in good faith. Where a time cannot be met, we will inform you as early as possible and offer alternatives.
7.3 The EPC reflects the property as assessed on the date of the assessment, produced according to the government-approved methodology. We do not guarantee any particular rating.
8. Price information on the Website
Guide prices and ranges shown on the Website are indicative. The price that applies is the price in your quote.
9. Website content
Guides and articles on the Website are general information only, not professional, legal or financial advice.
10. Our liability
10.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited by law, including your statutory rights under the Consumer Rights Act 2015.
10.2 Subject to 10.1, our total liability arising out of or in connection with a booking is limited to the price payable for that booking.
10.3 Subject to 10.1, we are not liable for losses that are not a foreseeable result of our breach, or for losses arising from inaccurate or incomplete information you provided.
11. Data protection
We use your personal data as described in our Privacy Policy, including sharing it with our assessment provider to carry out your assessment.
12. Complaints
Contact complaints@simple-epc.uk and we will acknowledge within 2 working days and respond substantively within 14 days. Complaints about the conduct of an assessment may also be raised with the assessor's accreditation scheme; we can direct you to the right scheme.
13. General
We may update these Terms; the version in force when you book applies to that booking. These Terms are governed by the law of England and Wales and subject to the jurisdiction of its courts. Nothing in these Terms affects your statutory rights.
